These Terms of Service govern your use of BriefAI. Please read them carefully before creating an account or using the Service. By using BriefAI, you agree to these Terms.
1. Acceptance of Terms
By accessing or using BriefAI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of BriefAI, including freelancers who create accounts ("Users") and their clients who interact with brief pages ("Clients").
We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
2. Description of Service
BriefAI is a SaaS platform that allows freelancers and independent professionals to create AI-powered project intake forms. Each User receives a unique public link that their clients can use to complete a conversational brief.
The Service uses the Anthropic Claude AI to conduct conversations with clients, collect project requirements, and generate structured summaries. Users can review completed briefs from their dashboard.
BriefAI is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation and reserve the right to modify or discontinue features with reasonable notice.
3. Account Registration
To use BriefAI you must register an account with a valid email address, a unique username, and a password. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
You must be at least 16 years old to create an account. By registering, you represent that you meet this requirement.
You may not impersonate another person, use a misleading username, or create an account on behalf of someone else without their permission. We reserve the right to suspend or terminate accounts that violate this section.
4. User Obligations & Acceptable Use
You agree to use BriefAI only for lawful purposes and in accordance with these Terms. You must not use the Service to collect information from minors, engage in spam or phishing, distribute malware, or violate any applicable law or regulation.
You are solely responsible for the content of your brief pages, including your display name, bio, custom system prompts, and questions. You must not configure the AI to impersonate real people, generate harmful content, or deceive clients in a way that causes harm.
You agree not to attempt to reverse-engineer, scrape, overload, or otherwise interfere with the Service's infrastructure. Automated access without our prior written consent is prohibited.
We reserve the right to remove content or suspend accounts that we determine, at our sole discretion, violate these obligations.
5. Payment Terms
BriefAI offers a free plan with limited features and paid plans (Pro and Max) with additional capabilities. Paid plans are billed monthly or annually, as selected at checkout.
Payments are processed by Paddle, a merchant of record that handles billing, tax compliance, and invoicing on our behalf. By subscribing to a paid plan, you agree to Paddle's terms and authorise recurring charges to your payment method.
All prices are listed in USD and are exclusive of any applicable taxes. Paddle will add applicable VAT, GST, or sales tax at checkout based on your location.
Subscription fees are charged at the start of each billing period. If a payment fails, we will retry the charge and may downgrade or suspend your account until payment is received.
6. Cancellation Policy
You may cancel your paid subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period — you will not be charged for the next period.
We offer a 30-day money-back guarantee for new Pro and Max subscriptions. If you are not satisfied within the first 30 days, contact us at support@briefai.com for a full refund. After 30 days, fees are non-refundable except as required by law.
On cancellation, your account reverts to the Free plan. Your data (briefs, settings) is retained for 90 days after cancellation before permanent deletion, giving you time to export anything you need.

7. Intellectual Property
BriefAI and its original content, design, code, and branding are owned by BriefAI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
You retain ownership of all content you create through the Service, including your question templates, system prompts, and brief data. By using the Service, you grant BriefAI a limited, non-exclusive licence to store and process that content solely to operate and improve the Service.
Client brief data (conversations and summaries generated on your public page) is considered content collected on your behalf. You are responsible for obtaining any necessary consent from clients regarding data collection and AI processing.
8. Limitation of Liability
To the maximum extent permitted by law, BriefAI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to BriefAI in the 12 months preceding the claim.
We do not warrant that the Service will be error-free, secure, or uninterrupted. AI-generated content may be inaccurate or incomplete — you are responsible for reviewing brief outputs before relying on them.
9. Termination
You may close your account at any time by contacting support. On termination, your access to paid features ends immediately and your data is scheduled for deletion per section 6.
We may suspend or terminate your account immediately, without notice, if you breach these Terms, engage in fraudulent activity, or if required by law. We will make reasonable efforts to notify you of the reason.
Provisions that by their nature should survive termination — including sections on intellectual property, limitation of liability, and governing law — will remain in effect after termination.
10. Governing Law & Disputes
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation.
If a dispute cannot be resolved informally within 30 days, either party may pursue the matter through binding arbitration or a court of competent jurisdiction, as appropriate under your local consumer protection laws.
Nothing in these Terms limits any rights you may have as a consumer under mandatory provisions of your local law.
